About Softonic
Software Purchase
Softonic offers its users the possibility to purchase software or software licences.
Softonic is not responsible for the software programs offered, nor for their descriptions or prices. Softonic only provides the technical platform for software producers, acting solely as an intermediary.
Softonic provides an e-commerce system for the distribution and sale of software programs.
Methods of distribution
There are two methods of distribution offered by Softonic. If available, both alternatives will be presented during the ordering process and be chosen according to the user's preference.
- Via Email
-
This purchase method consist in the user ordering either a licence code to convert a trial software version into a full version, or a download URL plus access code in order to download the full version of the software program in question. Softonic and/or the software producer will send the corresponding information to the user's e-mail address specified during the ordering process. In case the trial version of a software program was needed, it can be downloaded directly from Softonic's own servers.
The sales agreement will enter into force with Softonic and/or the software producer sending the licence information to the user's e-mail address specified during the ordering process. It will be solely up to the user if and when the full or trial version of the ordered software program is downloaded from Softonic and if and when the activation code is used, although it may only be done within a period of 14 days after receiving the licence data.
- Via CD-ROM
-
In this case, the user orders the software program as a physical product on a CD-ROM as data carrier. Should this distribution method be chosen, the user's order, be it via internet, telephone, fax or mail, constitutes a binding agreement. Softonic or the producer of the software program in question may then either confirm the order by sending a confirmation within 14 days, or deliver the product by mail within the same period of time.
To effect the ordering process, the user must complete the required order form, accept the terms and conditions at hand and confirm the order by clicking on the button "Send order".
Methods of payment
Softonic offers its users the following method of payment for the ordered software programs or software licences:
- Credit card
-
In order to guarantee a secure data transfer and a safe transaction, Softonic relies on a data transfer system with SSL encryption (Secure Sockets Layer). This encryption is authenticated with VeriSign.
MetaCharge handles this payment process, guaranteeing secure payment via credit card. Your credit card details will never be given to or saved by Softonic. MetaCharge accepts Visa, MasterCard/Eurocard and American Express as means of payment.

Back to topRights of use
On complete payment of the amount invoiced, the user shall be granted a permanent ordinary right of use of the software program or software licence purchased. The range of this ordinary right of use is specified in the purchase description or during the ordering process.
With the exception of a backup copy, the user may neither temporarily nor permanently copy parts of or the entire purchased software program by any means and in any form. The user may resell the right of use of the software program or the software licence, unless the software program or the software licence was acquired via delivery per e-mail as stated under the section Methods of distribution. In reselling the right of use, the user renounces their own right of use. In this case, any installations and backup copies will have to be deleted completely. Unless explicitly stated by Softonic, the applicable conditions of use and licence agreements will be those specified by the producer of the software program or the software licence purchased. These conditions and agreements can be found in the EU LA (End User License Agreement) delivered together with the product.
Back to topWarranty
The user will check the delivered software program or software licence for defects immediately after delivery. In order to preserve the warranty rights, the user shall have to report obvious defects in written form to Softonic within 14 days after receiving the product.
In advance, Softonic will assign the warranty claim towards the software producer to the user. In accepting the terms and conditions at hand, the user will accept this assignment. Should the program possess any kind of defect, the user will address the producer, thus exercising the warranty claim assigned to the user. If the producer refuses any warranty claims, the user may exercise a right of rectification with regards to Softonic. Softonic may also provide a replacement by delivering the software program or software licence in question anew. Should rectification or replacement fail, the user may demand for Softonic to reduce the licence fee or to cancel the contract.
Softonic does not vouch for any characteristics of the program, above all in terms of usability and compatibility with other programs or operating systems. Nobody but the user shall be responsible for choosing the software.
Furthermore, it is always the producer who is responsible for the technical support of the purchased computer program, never Softonic.

Any user claims for damages caused by installing and using the purchased software program shall be excluded. Softonic shall not be liable for any data loss, lost profits and any other financial loss experienced by the user partially or fully due to the use of the purchased software programs or software licences.
In case of gross negligence or intended action on behalf of Softonic, Softonic shall not be exempt from liability. Furthermore, the liability exemption shall not be applicable in case of slight negligence of basic duties; however, in this case liability is limited to replacing the typical damage as was predictable on concluding the contract.
