'The Pitt' is trying to dismiss a lawsuit from the creator of 'ER'… because, basically, it doesn't resemble 'ER' at all

I think that all of us who regularly watch series have been in a long season where one in every two words we say or write is “Pitt.” And it’s no wonder: The Pitt, in its second season, has proven to be on par with the first and is paving the way for a glorious future… unless the creator of ER gets his way.
Three grams of tranquilizer!
That’s right: the heirs of Michael Crichton (sadly passed away in 2008) have been trying for two years to sue The Pitt for its alleged resemblance to ER. They claim that Crichton made it clear that he had to approve any derivative product of his series, but there is just one problem: The Pitt is not a derivative product of ER. Not at all, in fact.
“The Pitt does not contain protected elements from ER: besides sharing a genre (hospital drama) and some specific topics of the genre that are impossible to protect, such as the use of medical jargon, the two series are not similar at all”. It’s true: for example, The Pitt takes place in real-time exclusively within the hospital, while ER was a more classic series in that sense. Sure, but… what about Noah Wyle?
Well, the character from ER and the one from The Pitt are different, no matter how much fans have theorized to connect them. We would never see Dr. Carter about to crash with the motorcycle as it is suggested that Dr. Robinavitch plans to do between seasons of the HBO series. Only a judge will decide if this goes to trial, but personally, I think they should declare him dead right now.
