Trump faces new Truth Social lawsuit: $100,000 early access to posts

Donald Trump got hit with a new lawsuit today. The Intercept and the Freedom of the Press Foundation are challenging Trump Media & Technology Group over its Truth API, a feed the plaintiffs say costs between $60,000 and $100,000 a month and gives paying subscribers earlier access to Trump’s Truth Social posts.

According to The Intercept and the Freedom of the Press Foundation, the feed pushes out posts from high-profile accounts, including Trump’s, a fraction of a second before they appear in the public feed. They argue that tiny head start matters to Wall Street traders, high-frequency firms, political-intelligence shops, and news organizations, especially when Trump’s posts function as presidential statements and the White House never repeats them.

The complaint was filed in the U.S. District Court for the Southern District of New York. It names Trump in his official capacity, along with aides Natalie Harp and Daniel Scavino, the Executive Office of the President, and the White House Office. The suit argues that selling quicker access to official communications to favored customers runs afoul of the First and Fifth Amendments.

If you track Trump Media & Technology Group, or you pay attention to presidential posts that can move markets, this is one to keep an eye on. Interim CEO Kevin McGurn has said more than 10 customers have signed up. Democrats have asked the U.S. Securities and Exchange Commission to look at market-integrity concerns. Trump Media, for its part, says the lawsuit is politically motivated and argues that selling real-time public data is standard practice.

The case is in the U.S. District Court for the Southern District of New York.
